תקנון זה מסדיר את השימוש באפליקציית תשחץ, המופעלת על ידי בן באשא ("אנחנו"). התקנת האפליקציה או שימוש בה מהווים הסכמה לתקנון. יצירת קשר: tashchetz@benbasha.com.

1. מה האפליקציה

תשחץ היא משחק תשחץ (arroword) יומי בעברית: רשת אחת, רמזים בתוך המשבצות, ואתם משלימים את המילים. האפליקציה כוללת תשחץ יומי, מאגר של מעל 1000 תשחצים בארבע רמות, מצב טיולים לא מקוון, רצף יומי, משימות, לוחות מובילים, קרבות מול שחקנים אחרים, ועורך לבניית תשחצים ושיתופם עם הקהילה.

2. רישיון שימוש

אנחנו מעניקים לכם רישיון אישי, לא בלעדי ולא ניתן להעברה, להשתמש באפליקציה במכשירים שבבעלותכם, לשימושכם הפרטי. אסור להעתיק, לשנות, להפיץ, למכור, להשכיר או לבצע הנדסה לאחור של האפליקציה או לחלץ את קוד המקור שלה, אלא במידה שהדין מתיר זאת על אף תנאים אלה.

3. חשבון

אפשר לשחק את התשחץ היומי ולפתור תשחצים בלי חשבון. כדי להשתמש בלוחות מובילים, בקרבות, בתגובות ובפרסום תשחצים, נדרשת התחברות עם Sign in with Apple ובחירת כינוי ותמונת פרופיל. אתם אחראים לפעילות בחשבונכם. אנחנו רשאים להסיר כינוי, תמונת פרופיל או תוכן פוגעניים או מטעים.

4. הגרסה החינמית ופרסומות

האפליקציה חינמית לשימוש, וכל התשחצים והתשחץ היומי פתוחים בחינם. הגרסה החינמית מציגה פרסומות של Google AdMob (פירוט במדיניות הפרטיות בכתובת tashchetz.benbasha.com/privacy). פרסומת אף פעם לא קוטעת באמצע פתרון.

5. נתונים ופרטיות

ההתקדמות, הרצף וההגדרות שלכם נשמרים על המכשיר. לחשבונות מחוברים, פרופיל, התקדמות, מטבעות, תוצאות ותוכן קהילה נשמרים גם בשרת שלנו. הכינוי ותמונת הפרופיל גלויים לשחקנים אחרים בקרבות, בלוחות המובילים ולצד תשחצים שפרסמתם. אין באפליקציה כלי אנליטיקה או דיווח קריסות של צד שלישי. מה נאסף, מדוע, ואילו אפשרויות יש לכם מתואר במדיניות הפרטיות בכתובת tashchetz.benbasha.com/privacy. השימוש באפליקציה מהווה הסכמה לעיבוד כפי שמתואר שם.

6. מטבעות, חבילות מטבעות ותשחץ פלוס

• מטבעות וירטואליים משמשים בתוך המשחק בלבד. אין להם ערך כספי, אינם ניתנים לפדיון לכסף, ואינם ניתנים להעברה. אנחנו רשאים להתאים את העלויות וההטבות במשחק מעת לעת.
• חבילות מטבעות הן רכישות בתוך האפליקציה (מוצרים מתכלים). תשחץ פלוס הוא מנוי בתשלום (חודשי או שנתי) עם שבוע ניסיון חינם, המסיר פרסומות, מכפיל מטבעות על כל תשחץ שתפתרו, ופותח חבילות בלעדיות.
• חיוב וחידוש: החיוב מתבצע כולו על ידי ה-App Store של אפל בהתאם לתנאיו. המנוי מתחדש אוטומטית בסוף כל תקופה, אלא אם תבטלו את החידוש לפחות 24 שעות לפני סוף התקופה הנוכחית, דרך הגדרות חשבון ה-App Store. ניהול וביטול המנוי מתבצעים בהגדרות חשבון ה-App Store.
• החזרים מטופלים על ידי אפל לפי מדיניות ההחזרים שלה; אין לנו אפשרות לבצע החזרים ישירות.

7. תוכן שיוצרים משתמשים

אם אתם בונים ומפרסמים תשחץ, אתם מצהירים שיש לכם הזכות לעשות כן ושהתוכן אינו מפר זכויות של אחרים, אינו פוגעני ואינו בלתי חוקי. אתם מעניקים לנו רישיון לא בלעדי, ללא תמלוגים, להציג, לשכפל ולהפיץ את התוכן שפרסמתם בתוך האפליקציה ובשירות. אנחנו רשאים לבדוק, לסרב לפרסם או להסיר תוכן שמפר תקנון זה.

8. שימוש הוגן

אתם מתחייבים שלא לעשות שימוש לרעה באפליקציה, ובכלל זה לא לרמות בקרבות או בלוחות המובילים, לא להשתמש באוטומציה או בכלים לעקיפת מנגנוני המשחק, לא לנסות לעקוף את אימות הרכישות, ולא לגרד (scrape) או לארוז מחדש את תוכן האפליקציה. הפרה עלולה לגרור פסילת תוצאות, חסימה או השעיית החשבון.

9. הסרת אחריות

האפליקציה מסופקת "כפי שהיא" (AS IS) ובכפוף לזמינותה, ללא אחריות מכל סוג, מפורשת או משתמעת, לרבות בנוגע לדיוק, לזמינות רציפה או להתאמה למטרה מסוימת. תכונות מרובות משתתפים, נוכחות ולוחות מובילים תלויות בקישוריות רשת ועשויות שלא להיות זמינות בכל עת.

10. הגבלת אחריות

במידה המרבית המותרת בדין, לא נהיה אחראים לנזקים עקיפים, נלווים או תוצאתיים הנובעים מהשימוש באפליקציה, לרבות אובדן מטבעות, תוצאות, רצף או נתונים. סך אחריותנו לכל תביעה מוגבל לסכום ששילמתם לנו בפועל באמצעות רכישות בתוך האפליקציה בשנים עשר החודשים שקדמו לאירוע (או אפס אם לא ביצעתם רכישה).

11. שינויים באפליקציה או בתקנון

אנחנו רשאים לעדכן, לשנות או להפסיק את האפליקציה או כל יכולת בה בכל עת. אם התקנון ישתנה באופן מהותי, הגרסה המעודכנת תפורסם בכתובת tashchetz.benbasha.com/terms עם תאריך תוקף חדש; המשך שימוש לאחר שינוי מהווה הסכמה לתקנון המעודכן.

12. סיום ומחיקת חשבון

אפשר להפסיק להשתמש באפליקציה בכל עת על ידי מחיקתה, ולמחוק את החשבון מתוך האפליקציה. אנחנו רשאים להשעות או לסגור חשבון של מי שמפר תקנון זה הפרה מהותית.

13. דין וסמכות שיפוט

על תקנון זה חלים דיני מדינת ישראל, ולבתי המשפט המוסמכים בישראל סמכות שיפוט בלעדית בכל מחלוקת הנובעת ממנו.

These terms govern your use of the תשחץ (Daily Hebrew Crossword) mobile app, operated by Ben Basha ("we"). By installing or using the app you accept them. Contact: tashchetz@benbasha.com.

1. What the app is

תשחץ is a daily Hebrew arrowword game: one grid, clues inside the cells, you fill in the words. The app includes a daily crossword, a library of over 1,000 puzzles across four levels, an offline travel mode, a daily streak, missions, leaderboards, matches against other players, and an editor to build and share your own puzzles with the community.

2. License to use

We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own, for your own personal use. You may not copy, modify, distribute, sell, rent, or reverse-engineer the app or extract its source code, except where the law allows it despite these terms.

3. Account

You can play the daily crossword and solve puzzles without an account. To use leaderboards, matches, reactions, and publishing, you must sign in with Sign in with Apple and choose a nickname and avatar. You are responsible for activity on your account. We may remove offensive or misleading nicknames, avatars, or content.

4. Free version and ads

The app is free to use, and all puzzles and the daily crossword are free. The free version shows Google AdMob ads (details in the privacy policy at tashchetz.benbasha.com/privacy). An ad never interrupts you in the middle of solving.

5. Data and privacy

Your progress, streak, and settings are stored on your device. For signed-in accounts, your profile, progress, coins, results, and community content are also stored on our server. Your nickname and avatar are visible to other players in matches, on leaderboards, and next to puzzles you publish. The app contains no third-party analytics or crash-reporting SDK. What is collected, why, and the choices you have are described in the privacy policy at tashchetz.benbasha.com/privacy. By using the app you agree to that processing as described there.

6. Coins, coin packs, and Tashchetz Plus

• Virtual coins are for in-game use only. They have no monetary value, cannot be redeemed for cash, and are non-transferable. We may adjust in-game costs and rewards from time to time.
• Coin packs are in-app purchases (consumable products). Tashchetz Plus is a paid subscription (monthly or yearly) with a one-week free trial that removes ads, doubles coins on every puzzle you solve, and unlocks exclusive packs.
• Billing and renewal: billing is handled entirely by Apple's App Store under its terms. A subscription auto-renews at the end of each period unless you cancel renewal at least 24 hours before the end of the current period, through your App Store account settings. You manage and cancel subscriptions in your App Store account settings.
• Refunds are handled by Apple under its refund policy; we cannot issue refunds directly.

7. User-generated content

If you build and publish a puzzle, you represent that you have the right to do so and that the content does not infringe others' rights, is not offensive, and is not unlawful. You grant us a non-exclusive, royalty-free license to display, reproduce, and distribute the content you publish, within the app and the service. We may review, refuse to publish, or remove content that violates these terms.

8. Acceptable use

You agree not to misuse the app, including cheating in matches or on leaderboards, using automation or tools to bypass game mechanics, attempting to bypass purchase verification, or scraping or repackaging the app's content. Violations may result in disqualified results, blocking, or suspension of your account.

9. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, uninterrupted availability, or fitness for a particular purpose. Multiplayer, presence, and leaderboard features depend on network connectivity and may not be available at all times.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from use of the app, including loss of coins, results, streak, or data. Our total liability for any claim is limited to the amount you actually paid us through in-app purchases in the twelve months before the event (or zero if you made no purchase).

11. Changes to the app or these terms

We may update, change, or discontinue the app or any feature at any time. If these terms change materially, the updated version will be posted at tashchetz.benbasha.com/terms with a new effective date; continued use after a change means you accept the updated terms.

12. Termination and account deletion

You may stop using the app at any time by deleting it, and you may delete your account from inside the app. We may suspend or close the account of anyone who materially breaches these terms.

13. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any dispute arising from them.
